Terms of Service

These terms cover your use of tvoc.live and the TVOC applications, provided by TVOC Creator Network Limited, a company registered in New Zealand. By creating an account you agree to them.

Your account

You must be at least 13 years old to hold an account, and old enough to form a binding contract where you live. You are responsible for what happens under your account and for keeping your password to yourself. Tell us at support@tvoc.live if you think someone else has access to it.

Usernames are first come, first served. We may reclaim a username that impersonates someone, infringes a trade mark, or is being squatted on.

Your profile and your content

You keep ownership of everything you put on your profile. You give us permission to host and display it so the profile page can work. You are responsible for having the rights to what you upload.

Do not use TVOC to publish content that is:

• unlawful, or that infringes somebody else's rights;
• sexual content involving minors, or any content that sexualises a minor;
• harassment, threats, or incitement to violence;
• malware, phishing, or attempts to break into other people's accounts.

We can suspend or remove an account that breaks these rules. Where it is reasonable to do so, we will tell you why.

The applications

TVOC LIVE connects to third-party services on your behalf — TikTok LIVE (through Euler Stream or TikTool), Twitch, YouTube and Kick, and optionally Spotify. Your use of those services is governed by their terms as well as ours, and we cannot control whether they remain available. Song queueing requires an active Spotify Premium subscription, which is Spotify's requirement and not ours.

Payments

Prices are in US dollars unless a page says otherwise. Card payments on tvoc.live are processed by Stripe; TVOC never sees or stores your card details.

Tips and ranks bought on a creator's page

When you tip a creator or buy a rank on their page, you are paying the creator, not TVOC. The payment goes to the creator's own Stripe account, and the creator is the seller. TVOC takes a platform fee of 5% of each payment; Stripe's own processing and currency conversion fees also come out of it. The smallest tip is $5.

A tip is a gift: nothing is delivered in return, and it is not refundable through TVOC. A rank gives the name you enter the rank in that creator's app for the time shown when you buy it. Refunds for tips and ranks are the creator's decision and come out of their Stripe balance — contact the creator first, and write to us if you cannot reach them. A chargeback is also taken from the creator's balance.

Creators: to take tips and sell ranks you connect your own Stripe account, and Stripe's terms for connected accounts apply to it. You are responsible for what you sell on your page, for refunds you choose to give, and for any tax on what you receive.

TVOC LIVE Pro

Pro is a subscription, billed monthly, every three months or yearly at the price shown on the Plans page when you subscribe. It renews automatically at the end of each period until you cancel. You can cancel at any time from your account; Pro then stays on until the end of the period you have paid for, and nothing more is charged. We do not refund part of a period, except where the law requires it. Try out Pro is a single payment for five days of Pro and does not renew.

If we change the price of Pro, we will email you before the new price applies to your next renewal, so you can cancel first if you want to.

On iPhone, Pro can also be bought through Apple. Those subscriptions are billed, renewed, cancelled and refunded by Apple under Apple's terms — manage them in your iPhone's Settings, not on tvoc.live.

Availability

The software is provided as it is. We work to keep it running, but we do not promise uninterrupted service, and a live stream depends on several things outside our control — your phone, your connection, and the platforms we connect to. Do not rely on TVOC as the only record of anything you cannot afford to lose; export your viewer log.

Liability

To the extent the law allows, TVOC is not liable for indirect or consequential loss, including lost revenue or lost stream time. Nothing in these terms limits rights you have under the New Zealand Consumer Guarantees Act or any other law that cannot be excluded by agreement.

Ending it

You can close your account at any time from your account page, or by writing to us. We may end or suspend an account for a breach of these terms, or if we stop offering the service — in which case we will give reasonable notice so you can export your data.

Changes

We may update these terms. The date at the top will change, and where an update materially affects you we will email account holders, at the address on their account, before it takes effect — normally at least two weeks before. If you do not agree with a change, you can close your account before it applies.

Law

These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction over any dispute.
